Welcome to raw. These Terms of Service ("Terms") govern your access to and use of the raw mobile application, website, and all related services (collectively, the "Service") operated by Raw, Inc., a Delaware corporation ("Raw," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
By creating an account, downloading the raw application, or otherwise accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. These Terms constitute a legally binding agreement between you and Raw, Inc.
2.1. You must be at least thirteen (13) years of age to use the Service. If you are under 13, you may not create an account or use the Service under any circumstances. This requirement is in compliance with the Children's Online Privacy Protection Act ("COPPA").
2.2. If you are a resident of the European Union, European Economic Area, or the United Kingdom, you must be at least sixteen (16) years of age to use the Service without parental or guardian consent. Users between the ages of 13 and 15 in these jurisdictions may only use the Service with verified parental or guardian consent, in accordance with the General Data Protection Regulation ("GDPR").
2.3. By using the Service, you represent and warrant that you meet the applicable age requirements and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.
3.1. To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary to keep it accurate, current, and complete.
3.2. You are responsible for safeguarding your account credentials. You agree not to share your login information with any third party and to immediately notify Raw of any unauthorized access to or use of your account.
3.3. You are solely responsible for all activity that occurs under your account, whether or not you authorized such activity.
4.1. Your Content. You retain all ownership rights in the videos, images, text, and other materials you create, upload, or share through the Service ("User Content"). Raw does not claim ownership of your User Content.
4.2. License Grant to Raw. By uploading, submitting, or otherwise making available User Content through the Service, you grant Raw, Inc. a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, cache, reproduce, display, perform, distribute, and otherwise use your User Content in connection with operating, developing, providing, promoting, and improving the Service and researching and developing new services. This license persists for as long as your User Content remains on the Service and for a reasonable period thereafter necessary to remove it from our systems (typically no more than 90 days following deletion).
4.3. Representations. You represent and warrant that you own or have the necessary rights, licenses, consents, and permissions to grant the foregoing license, and that your User Content does not infringe or violate any third party's intellectual property rights, privacy rights, or any applicable law or regulation.
4.4. Raw's Content. The Service, including all software, designs, text, graphics, logos, and other materials provided by Raw (excluding User Content), is owned by or licensed to Raw, Inc. and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of Raw's content without prior written consent.
5.1. Core Service Feature. Authenticity verification is a core component of the raw platform. All User Content uploaded to or recorded through the Service is subject to automated and, where applicable, manual authenticity analysis designed to detect tampering, manipulation, AI generation, and other forms of content alteration.
5.2. User Acknowledgment. By using the Service, you acknowledge and agree that: (a) all content you upload or create will be analyzed by our authenticity verification systems; (b) an authenticity score or verification status will be assigned to your content and may be visible to other users; and (c) content flagged as potentially tampered, manipulated, or artificially generated may be labeled with a warning, have its distribution restricted, or be removed from the Service at Raw's sole discretion.
5.3. Detection Methods. Raw employs multiple detection methods including, but not limited to, moiré pattern analysis, flicker detection, flash verification, motion sensor correlation, edge-consistency analysis, and metadata examination. These methods are continuously updated and improved.
5.4. Prohibited Conduct. You agree not to: (a) upload content that has been digitally altered, filtered, AI-generated, or otherwise tampered with and present it as authentic; (b) attempt to circumvent, disable, or interfere with the authenticity verification systems; (c) reverse-engineer or probe the detection algorithms; or (d) use the Service for the purpose of testing or defeating the anti-tampering technology.
6.1. Raw provides authenticity scoring and verification as a service feature. While we employ multiple sophisticated detection methods and continually improve our technology, we do not guarantee and cannot warrant 100% accuracy in identifying tampered or authentic content.
6.2. No Absolute Guarantee. Authenticity verification results are probabilistic assessments, not definitive determinations. False positives (authentic content incorrectly flagged as tampered) and false negatives (tampered content not detected) may occur. Raw shall not be liable for any damages arising from inaccurate verification results.
6.3. Not Legal Evidence. Verification results provided by the Service are not intended to serve as forensic evidence or legal proof of content authenticity or tampering. Users should not rely solely on Raw's verification for legal, journalistic, or other high-stakes determinations.
6.4. Liability Disclaimer — Authenticity Is a Signal, Not a Certification. Raw expressly disclaims any representation or warranty that content processed through the Service is, or is not, authentic, unaltered, untampered, human-captured, or free of artificial or synthetic generation. Raw's tamper detection is probabilistic and best-effort: it combines multiple on-device signals (including moiré-pattern analysis, screen-flicker analysis, flash challenge-response, gyroscope motion correlation, and edge-sharpness compositing) to produce a score that indicates likelihood, not certainty. Authenticity cannot and will not be guaranteed at one hundred percent (100%). A low tamper score is not a declaration that content is genuine; a high tamper score is not a declaration that content is fake. Raw, Inc. makes a good-faith, best-effort signal designed to help viewers weigh the evidence, and is not a forensic laboratory, certifying authority, notary, or legal certification body. Any reliance on a verification result — including but not limited to journalistic, evidentiary, insurance, licensing, commercial, or judicial use — is at the relying party's sole risk. Raw shall not be liable to any user or third party for any loss, damage, or claim arising from reliance on, or from the accuracy or inaccuracy of, any authenticity score, tamper flag, or verification status issued by the Service.
7.1. Raw respects the intellectual property rights of others and expects users to do the same. We comply with the Digital Millennium Copyright Act ("DMCA") and respond to valid notices of alleged copyright infringement.
7.2. Filing a DMCA Notice. If you believe that your copyrighted work has been copied or used in a way that constitutes copyright infringement, you may submit a notification to our designated DMCA agent with the following information: (a) a physical or electronic signature of the copyright owner or authorized agent; (b) identification of the copyrighted work claimed to have been infringed; (c) identification of the material that is claimed to be infringing and its location on the Service; (d) your contact information; (e) a statement that you have a good-faith belief that use of the material is not authorized; and (f) a statement, made under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner.

7.4. Counter-Notification. If you believe your content was removed in error, you may submit a counter-notification containing: (a) your physical or electronic signature; (b) identification of the removed material and its prior location; (c) a statement under penalty of perjury that removal was a mistake or misidentification; and (d) your name, address, and consent to jurisdiction of the federal court in your district.
7.5. Repeat Infringers. Raw will terminate the accounts of users who are determined to be repeat infringers in appropriate circumstances.
8.1. Raw reserves the right, at its sole discretion, to suspend, restrict, or terminate your account and access to the Service at any time, with or without notice, for conduct that Raw determines: (a) violates these Terms or any applicable law or regulation; (b) is harmful to other users, Raw, or third parties; or (c) warrants such action for any other reason.
8.2. Tampered Content Enforcement. Without limiting the foregoing, Raw reserves the right to suspend or permanently terminate accounts that repeatedly attempt to upload tampered, manipulated, or artificially generated content. Enforcement follows an escalating process: (a) first offense results in content flagging and a warning; (b) second offense results in content restriction; (c) third offense may result in temporary account suspension; and (d) continued violations may result in permanent account termination. Raw reserves the right to deviate from this process at its discretion for severe violations.
8.3. Effect of Termination. Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, limitation of liability, and dispute resolution.
In addition to the anti-tampering prohibitions in Section 5, you agree not to use the Service to:
(a) Upload, post, or transmit content that is unlawful, defamatory, obscene, pornographic, harassing, threatening, invasive of privacy, or otherwise objectionable;
(b) Upload content depicting child sexual abuse material (CSAM) or the exploitation of minors in any form;
(c) Engage in hate speech, incitement of violence, or promotion of terrorism;
(d) Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity;
(e) Spam, solicit, or send unsolicited commercial communications;
(f) Interfere with, disrupt, or create an undue burden on the Service or the networks and servers connected to the Service;
(g) Use any automated means, including bots, scrapers, or crawlers, to access the Service;
(h) Attempt to gain unauthorized access to any portion of the Service, other user accounts, or any systems or networks connected to the Service.
10.1. THE SERVICE, INCLUDING ALL CONTENT, FEATURES, AND AUTHENTICITY VERIFICATION FUNCTIONALITY, IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
10.2. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RAW, INC. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
10.3. WITHOUT LIMITING THE FOREGOING, RAW DOES NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (B) THE RESULTS OBTAINED FROM THE USE OF THE SERVICE, INCLUDING AUTHENTICITY VERIFICATION RESULTS, WILL BE ACCURATE, RELIABLE, OR COMPLETE; (C) ANY ERRORS IN THE SERVICE WILL BE CORRECTED; OR (D) THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS.
10.4. VIDEO VERIFICATION AND AUTHENTICITY SCORING ARE PROVIDED "AS-IS." RAW MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY VERIFICATION RESULT, AUTHENTICITY SCORE, OR TAMPERING ASSESSMENT.
11.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RAW, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH: (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) ANY VERIFICATION RESULT, AUTHENTICITY SCORE, OR TAMPERING ASSESSMENT, WHETHER ACCURATE OR INACCURATE; (C) ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR CONTENT OR DATA; (D) ANY THIRD-PARTY CONDUCT ON THE SERVICE; OR (E) ANY OTHER MATTER RELATING TO THE SERVICE.
11.2. IN NO EVENT SHALL RAW'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO RAW, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
11.3. THE LIMITATIONS IN THIS SECTION APPLY REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED, INCLUDING NEGLIGENCE, AND EVEN IF RAW HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
You agree to indemnify, defend, and hold harmless Raw, Inc. and its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any applicable law or regulation; or (e) your violation of any third party's rights, including intellectual property and privacy rights.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
13.1. Informal Resolution. Before initiating any formal dispute resolution proceeding, you agree to first attempt to resolve the dispute informally by contacting us at legal@raw.ski. We will attempt to resolve the dispute informally within sixty (60) days. If the dispute is not resolved within that period, either party may proceed to binding arbitration.
13.2. Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The arbitration shall be conducted by a single arbitrator, in the English language, and the seat of arbitration shall be Wilmington, Delaware. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
13.3. Class Action Waiver. YOU AND RAW AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Unless both you and Raw agree otherwise, the arbitrator may not consolidate or join more than one person's or party's claims.
13.4. Exceptions. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights. Claims arising under COPPA or relating to the unauthorized collection of data from children are also excluded from mandatory arbitration.
13.5. Opt-Out. You may opt out of this arbitration provision by sending written notice to legal@raw.ski within thirty (30) days of first accepting these Terms. If you opt out, disputes will be resolved in the courts specified in Section 14.
14.1. These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law principles.
14.2. For any disputes not subject to arbitration, you agree to submit to the exclusive personal jurisdiction of the state and federal courts located in New Castle County, Delaware.
15.1. Raw reserves the right to modify these Terms at any time. When we make material changes, we will notify you by: (a) posting the updated Terms on the Service with a revised "Last Updated" date; (b) sending a notification through the Service or to the email address associated with your account; or (c) other reasonable means.
15.2. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the modified Terms, you must discontinue use of the Service and delete your account.
15.3. For material changes that adversely affect your rights, we will provide at least thirty (30) days' notice before the changes take effect.
16.1. Entire Agreement. These Terms, together with the Privacy Policy and Community Guidelines, constitute the entire agreement between you and Raw regarding the Service and supersede all prior or contemporaneous agreements, understandings, or representations.
16.2. Severability. If any provision of these Terms is held to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
16.3. Waiver. The failure of Raw to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
16.4. Assignment. You may not assign or transfer these Terms or your rights hereunder without Raw's prior written consent. Raw may assign these Terms without restriction.
16.5. Force Majeure. Raw shall not be liable for any failure or delay in performing its obligations where such failure or delay results from events beyond its reasonable control, including but not limited to natural disasters, war, terrorism, epidemics, power failures, or internet disruptions.
